1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the website at rare-air.co.uk (the “Site”) operated by RARE AIR (IOM) LTD (“RARE AIR”, “we”, “us”, “our”), an aircraft buyer’s agent and aviation consultancy registered in the Isle of Man.
By accessing or using the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Nature of our business and the Site
RARE AIR acts as a buyer’s agent. We represent clients in the identification, evaluation, negotiation, and acquisition of aircraft. We do not act as a broker and we do not hold inventory.
The Site is primarily a marketing and contact site. It provides general information about our services and allows visitors to submit enquiries. The Site does not constitute an offer to sell or buy any aircraft, nor does it create a client relationship.
All actual aircraft acquisition work, consultancy, and related services are provided under separate written engagement agreements. Nothing on the Site replaces professional legal, tax, technical, or regulatory advice.
3. Contact form and communications
When you submit the contact form you are providing information (name, email, message) so that we may respond to your enquiry. We will use this information in accordance with our Privacy Policy.
We aim to respond promptly but make no guarantee of response times. We reserve the right to decline or not pursue any enquiry.
4. User accounts and authentication
Certain areas of the Site (for example staff or client portals) require authentication via Auth0. You are responsible for maintaining the confidentiality of your Auth0 credentials and for all activity that occurs under your authenticated session. You must notify us immediately of any unauthorised use.
We may suspend or terminate access at any time for suspected abuse, security reasons, or breach of these Terms.
5. Intellectual property
All content on the Site (text, images, logos, design, code) is owned by or licensed to RARE AIR unless otherwise indicated. You may not copy, reproduce, distribute, or create derivative works without our prior written consent, except for reasonable personal, non-commercial use or as permitted by applicable law.
Aircraft images and third-party marks are used for illustrative purposes and remain the property of their respective owners.
6. Disclaimers and limitation of liability
The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law.
In particular:
- We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
- Information on the Site is for general guidance only and may change without notice.
- We are not responsible for the content of external sites linked from the Site.
To the maximum extent permitted by law, RARE AIR, its directors, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of (or inability to use) the Site, whether in contract, tort (including negligence) or otherwise.
7. Aircraft services – separate agreements
Any engagement for buyer’s agent services, inspections, negotiations, ownership structuring, registration support, crew training, or related work is subject to a separate written agreement between you (or your entity) and RARE AIR. These Terms do not govern those services.
We work with clients’ legal, tax, and operational teams. All regulatory, airworthiness, and registration matters remain the responsibility of the client and their advisers.
8. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them or the Site shall be governed by and construed in accordance with the laws of the Isle of Man. The courts of the Isle of Man shall have exclusive jurisdiction, without prejudice to any mandatory consumer protections that may apply in your jurisdiction.
9. Changes to these Terms
We may amend these Terms at any time by posting the updated version on the Site with a new “Last updated” date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
